AdviceUK will be responding to the Home Office’s Asylum Appeals Consultation.

The Home Office has launched a new consultation seeking views on proposed reforms to the asylum appeals system.

The consultation, launched by the Home Office, is part of the Government’s plan to overhaul the asylum appeals system by creating a new independent appeals body. The deadline to submit evidence is on 22 April and AdviceUK will be responding. You will have real insight into how these proposals will affect your organisation and affected clients. The full consultation details are available here. A summary of the key proposals is as follows:

  • It would be separate from the existing courts/tribunals and staffed by independent adjudicators rather than traditional immigration judges.
  • Designed to handle asylum and immigration appeals at scale.
  • A central objective is to clear the large backlog of appeals and reduce waiting times.
  • The new system would:
    • Prioritise certain cases “as required by the wider public interest.”
    • Potentially operate with strict timelines and faster processes.
    • The new body may use “professional adjudicators” with wider eligibility criteria, not just legally qualified judges.
    • Enable access to translators and legal advice or representation.
