Ministry of Justice Study of Legal Advice at Local Level

The Ministry of Justice has published an implementation plan following its study of Legal Advice at Local Level. The results of the study were published in June.

Highlights:

  • Further research into complex and exceptional cases and 'difficult' clients
  • Piloting new approaches to funding exceptional cases in CLAC/N areas and new 2010 legal aid contracts
  • Monitoring of impact of fixed fees on supplier behaviour (cherry picking, juniorisation, early case closing)
  • A working group to analyse financial impacts on agencies of legal aid reforms and transitional arrangements
  • Legal Services Commission to work with Office of the Third Sector and Welsh Assembly Government Third Sector Unit to reduce bureaucratic burden - report in November 2009
  • Ministry of Justice to work with other Departments and Welsh Assembly to increase funding to improve back office functions of advice agencies
  • A working group, including AdviceUK to draft proposals by February 2010 for increasing accessibility of funding for non-legal aid activity and to look at demand for advice caused by failure of Government services (acknowledging AdviceUK's work on systems thinking - see It's the System Stupid!)
  • LSC to carry out full equalities impact assessment as part of CLAC and CLAN development, including impact on other funding
